Litigating In Court

At Riemer & Associates, we innovatively and aggressively litigate all of our court cases.  We have been instrumental in creating new law, and are always looking for ways to increase the rights of LTD claimants.

Your Involvement
We have clients who want to be involved every step of the way, and we have other clients who want very little involvement.  Litigation is very stressful and many clients want to minimize their involvement.  We take the lead from you. If you want to be involved, we act like a team, with you as an active member.  If you do not want to be involved, we shield you from the stress, keeping you informed of only major developments.

Settlement
At various stages of the litigation, there are often settlement talks.  We assist and advise you during this process.  We calculate the present value of your case, we inform you of the risks of continued litigation, and we advise you based on our experience whether a settlement is a good settlement and whether a better settlement could be obtained.  You have complete say over whether you want to take a settlement.

Disability cases are usually settled in one of two ways:

Lump sumUnder this manner of settlement, you will be paid a single amount of money in exchange for giving up all rights you have under the insurance policy.  The advantage of a settlement like this is that you get a sizeable amount of money now and you will not have to be involved with the insurer ever again.

Being Put on BenefitUnder this manner of settlement, you will be paid a single amount of money to compensate you for benefits owed to date, and you will be put on benefit with the insurer.  Under this settlement, you will continue to receive monthly benefits as long as you remain disabled under the terms of the insurance policy.  The disadvantage of this settlement is that you will be continuously monitored by the insurer while on benefit.  You may also find yourself in litigation again if the insurer decides to cut you off in the future.
